Abstract
This research investigates the legal implications of Artificial Intelligence (AI) in civil and commercial contracts، with a focus on cases involving the perishing of the contract object—that is، the destruction or loss of the subject matter of a contract. It examines how AI systems، through programming errors or autonomous decision-making، may cause unforeseen damages that affect contractual obligations. The study analyzes whether such incidents should be classified as force majeure or as faults that give rise to legal liability. It further evaluates the adequacy of existing legal frameworks in addressing these emerging challenges. By identifying legislative gaps and proposing appropriate legal and doctrinal solutions، the research seeks to strike a balance between technological innovation and the protection of contracting parties’ rights.
