Abstract

This research addresses civil liability for damages to natural resources in the Kingdom of Saudi Arabia. The introductory section explores the characteristics of natural resources and the various infringements against them. while the second section investigates the attribution of liability to the party causing the damage and the mechanisms for compensation.


Traditional liability frameworks may fall short in addressing the complex damages inflicted upon the environment; thus, the importance of strict liability (objective liability) becomes evident, as it obligates the responsible party to provide compensation without the necessity of proving fault. The party causing the damage may be held liable to compensate both the environment and affected individuals when their actions result in harm to both nature and private parties. The Saudi judicial system ensures the application of civil liability, the enforcement of compensation, and the protection of victims' rights, thereby enhancing the legal framework's efficacy in addressing infringements on natural resources.


Recommendations:


Specialized courts or judicial circuits dedicated to adjudicating cases involving natural resource infringements should be establish, accurately assessing damages, and mandating comprehensive remedial measures.


Also, government bodies should organize advanced training programs for technical experts, environmental protection officers, judges, and members of the Public Prosecution involved in these cases.


 the judiciary should be encouraging to adopt more flexible standards for proving the elements of tortious liability to protect natural resources and victims, facilitating their access to compensation-particularly in litigation against large corporations and industrial facilities.


Finally, expanding awareness programs focused on the vital importance of preserving natural resources.
