Abstract

This research explores the evidentiary value of artificial intelligence (AI) outputs in the Islamic judiciary, within the context of digital transformation and the adoption of AI technologies to analyze cases and expedite judicial procedures. The study reviews the concept of the Islamic judiciary, the importance of evidentiary means, and the authority of traditional evidence. It further examines AI applications in judicial systems at both international and Arab levels, highlighting the limitations of AI’s role in issuing Islamic judicial rulings.


The research investigates the possibility of considering AI outputs as part of Islamic evidentiary methods, noting that Islamic jurisprudence permits the use of modern tools as long as they do not conflict with Sharia. AI outputs are recommended to serve as supporting tools for judges rather than as independent sources for issuing rulings.


The study concludes that AI can enhance the efficiency and accuracy of judicial processes within the Islamic judiciary under specific guidelines, while ensuring that Sharia objectives and justice are preserved. It recommends the development of Sharia-compliant frameworks for AI use, training judges on proper application, and safeguarding the confidentiality of judicial data.
