The Required Reasons to Switch from the Original in the Fatwa

Abstract

The strength and vitality of Islamic jurisprudence appears in its interaction with various events, developments and changes. It got familiar with matters where it incorporates them. Those matters are started to be considered as a principle to follow. When issues that contradict such a principle are encountered, they are not followed and therefore are contemplated. Therefore, what is acceptable will be followed, but what is considered unsatisfactory is rejected.


Methodology:


1-Extrapolating texts in which there is a departure from the original


2-Relying on primary sources in collecting scientific material


3-Attributing Quranic verses to their surahs by mentioning the name of the surah and the verse number in the margin


4-Extracting the Prophetic hadiths from their original, approved references, and explaining the ruling of the relevant scholars regarding the hadith, and all of that if the hadith is in someone other than Al-Bukhari and Muslim, but if it is in them, then researcher suffices with mentioning its location and number.


5-Put punctuation marks in the appropriate place


6-When mentioning the source or reference for the first time, researcher mentions all the information related to it, which includes mentioning the full name of the book, the name of the author, the date of publication, the name of the publisher, the edition number and date, the country of publication, and the number of parts. The researcher symbolizes the edition number with the letter.
