Controls for a Husband’s Discipline of his Wife in Islamic Jurisprudence

Abstract

The research dealt with the subject of the husband disciplining his wife in accordance with the rules of sharia. If the woman breaks out and disobeys the husband، he has the right to fulfill her duty in several ways. It begins with admonishment، then desertion، then non-extreme beating. If it does not end، an arbitrator from his family and an arbiter from her family intervene to reconcile. Otherwise، the matter ends in divorce if they do not reach a solution or an agreement.


The research addresses the problem of some husbands going too far in the issue of discipline and exceeding the limits of Sharia law.


Based on the above research problem and its previous questions، a set of goals and objectives were formed that can contribute to clarifying these goals: Raising the level of the marital relationship and not dragging it down to the level of degrading the wife’s dignity. Explaining the limits permissible for the husband to discipline his wife. The goal of discipline should be reform، not revenge.


The importance of the research lies in explaining the methods of discipline and not exaggerating them or causing harm to the wife.
